Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Webinest service (the "Service") operated by Webinest ("us", "we", or "our"). Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

1. Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.

2. User Content and Responsibility

Our Service allows you to publish content from your Telegram channel to a public website. You are solely responsible for the content you publish ("User Content"), including its legality, reliability, and appropriateness. You represent and warrant that: (i) the User Content is yours (you own it) or you have the right to use it and grant us the rights and license as provided in these Terms, and (ii) the posting of your User Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights, or any other rights of any person.

By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to host, display, and distribute your User Content for the sole purpose of operating and providing the Service.

3. Prohibited Content and Activities

You agree not to use the Service for any purpose that is illegal or prohibited by these Terms. You are responsible for ensuring that your User Content and use of the Service comply with all applicable laws and regulations, as well as the policies of our payment partners, such as Stripe. The following is a non-exhaustive list of prohibited content and activities:

Illegal and High-Risk Activities

  • Any products, services, or activities that are illegal in the jurisdictions where your business is located or targeted.
  • Illegal drugs, substances designed to mimic illegal drugs, and equipment for making or using drugs.
  • Content that encourages or promotes unlawful violence, physical harm, or hate speech against individuals or groups based on race, religion, disability, gender, sexual orientation, or any other immutable characteristic.
  • Gambling, including casino games, lotteries, sports forecasting, and fantasy sports with a monetary prize.
  • Weapons, firearms, ammunition, explosives, and other dangerous materials.
  • Adult Content and Services.
  • Intellectual Property Violations.
  • Financial and Deceptive Practices.

We reserve the right, but are not obligated, to investigate and/or terminate your account without a refund if you have violated these Terms, misused the Service, or behaved in a way that we regard as inappropriate or unlawful. We are the sole arbiter of what constitutes a violation.

4. Fees and Payment

Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are typically set on a monthly or annual basis. At the end of each Billing Cycle, your Subscription will automatically renew unless you cancel it or we cancel it.

All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you shall be responsible for payment of all such taxes, levies, or duties. Payments are processed through third-party payment processors like Stripe. We do not store your full payment card details.

Refunds: Subscription fees are non-refundable except as required by law or as decided by us on a case-by-case basis. If you believe you are eligible for a refund, please contact our support team.

5. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may do so from your account settings.

6. Limitation of Liability

In no event shall Webinest, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

7. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of [Your Jurisdiction, e.g., Estonia], without regard to its conflict of law provisions.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
